Adventures24 GmbH - General Terms and Conditions

Corporate Object
1. Adventures24 GmbH presents the adventure offerings in Upper Austria under the protected name "Oberösterreich Adventures" (abbreviated as OÖA) in a clear manner, making a pre-selection for its customers based on criteria such as fun, adrenaline content, service, and safety. OÖA acts as a mediator for leisure activities but does not independently carry out the services. The organizers are various partners of OÖA (also called service partners), who independently perform the services on their own account and are solely responsible for the execution of adventures/experiences. The terms and conditions of the service partners apply to the execution.
2. A contract between OÖA and the customer is only established through the mediation service, and the following general terms and conditions apply to the version valid at the time of the order. The contract regarding the booking and execution of the respective adventure is concluded directly between the customer and the respective organizer. The fulfillment of the booked service is therefore not the subject of OÖA's obligation.
Vouchers
1. The customer purchases either a voucher for a specific type of adventure (Adventure Voucher) or a general voucher issued for a specific amount (PrePaid Voucher). The vouchers must be activated online for a specific adventure/experience so that the voucher can be redeemed with the partner. After activation, the customer and the service partner receive each other's contact details and can arrange a date for the adventure. The voucher must be presented to the organizer.
2. For Adventure Vouchers, there is the option to exchange them for a PrePaid Voucher. Thus, it is possible to decide on a different adventure until activation.
3. If the value of the chosen adventure is higher than the amount of the PrePaid Voucher, the price difference must be paid. Conversely, if the value of the chosen adventure is lower than the amount of the PrePaid Voucher, a residual credit remains on the voucher. The residual credit can be checked online with the voucher number.
4. The voucher can be redeemed within 3 years from the date of issue. After this period, a one-time extension of the voucher for another year is possible for a processing fee of €8.00 per voucher, plus the surcharge in case of a price increase in the adventure.
5. The voucher is transferable, but it is important to ensure that the person meets the participation requirements of the adventure.
6. Some adventures/experiences depend on a minimum number of participants, and if this is not met, the experience does not take place. In this case, the vouchers remain valid, and a new date will be announced.
7. The vouchers cannot be redeemed for cash.
Tickets
1. Unlike a voucher, a ticket has the organizer and the event date already fixed at the time of purchase. The ticket does not need to be activated, and the contact details of the organizer are already on the ticket. A right of withdrawal and exchange, similar to adventure vouchers, is excluded.
2. If the adventure cannot be carried out due to force majeure, especially due to bad weather conditions, the ticket can be redeemed on another day as if it were an adventure voucher. The decision on whether bad weather conditions prevail, leading to the cancellation of the event, lies solely with the organizer. Compensation for any travel or accommodation costs will not be provided. Unilateral withdrawal from the event contract is excluded unless there are important legal reasons. If the booker or participant and the organizer agree to cancel the event contract, the mediation by Oberösterreich Adventures can be undone. In this case, the booker or participant will be refunded the ticket value in the form of an Upper Austria value voucher. Cash payment is not possible.
Prices
1. All prices quoted are final prices and include the legal value-added tax. In addition to the specified prices, there may be costs for mediation, packaging, and shipping, which are separately indicated.
2. OÖA's price guarantee refers to the normal selling price of the service partners. Actions or discounts for certain groups of people are excluded from the price guarantee.
Discount and Benefit Codes
1. Discount or benefit codes cannot be combined with other discount promotions. Only one discount code can be redeemed per order. Discount codes have a limited validity and a minimum order value. For PrePaid Vouchers resulting from the exchange of Adventure Vouchers, later application of discount codes is not possible. An application in the case of an exchange for a PrePaid Voucher is not possible. Cash payment and retroactive application to already placed orders are excluded.
Payment Methods
1. The ordered vouchers can be paid by credit card, Paypal, Klarna, or Apple Pay. In exceptional cases, payment by bank transfer is possible. In the case of payment by invoice, the amount must be paid within one week after receiving the invoice; the vouchers will be released for activation only after OÖA has received the full payment. When paying by credit card, Paypal, Klarna, or Apple Pay, the voucher can be activated immediately.
Delivery
1. The delivery of the gift-wrapped voucher takes place within 3-7 working days to the address provided during the order. The PDF version for last-minute givers is, of course, available free of charge within a few minutes.
Right of Withdrawal
Consumers have the right to revoke their order within 14 days after receiving the vouchers without stating reasons, either in writing (letter, email) or by returning the originally packaged voucher with complete and unused content. To meet the withdrawal deadline, timely dispatch of the withdrawal or the goods is sufficient.
Consequences of Withdrawal:
The customer has to bear the costs of the return shipment if the price of the returned goods does not exceed €40.00 or if the customer has not yet provided the consideration or a partial payment at the time of withdrawal, unless the delivered goods do not correspond to the ordered goods. The repayment is made by transfer to an account specified by the customer. For all customers who activate their adventure/experiences within the 14 days, the 14-day right of withdrawal expires prematurely, as they automatically agree to an early termination of the right of withdrawal.

Physical Requirements of Participants
1. Participation in certain experiences requires a minimum level of personal suitability (e.g., height, age, health condition, weight). These requirements are specified in the individual adventure descriptions. After activation, the buyer of a voucher is responsible for ensuring that the person who is supposed to participate in the respective experience meets the minimum requirements. A refund of the purchase price is excluded in case of non-fulfillment of the minimum requirements.
Cancellation Right of the Organizer (Service Partner)
1. A right of cancellation also exists if the experience cannot be carried out due to force majeure, especially due to bad weather conditions. The decision on whether bad weather conditions prevail, leading to the cancellation of the event, lies solely with the organizer. Participants are obliged to consult with the organizer in a timely manner, with the latest possible time and necessary contact information stated in the booking confirmation. In the event of cancellation by the organizer, the participant has the right to make a free rebooking. Compensation for any travel or accommodation costs will not be provided.
OÖA's Cancellation Right
1. Until the activation of an experience by the voucher holder, OÖA is entitled to withdraw from the contract for an important reason. An important reason includes, for example:
- The organizer is no longer a service partner of OÖA or has generally ceased his business.
- The execution of the experience is economically unreasonable for the organizer
- Force of nature.
If one of these cases occurs, OÖA will inform you immediately.
In the event of withdrawal from the contract for an important reason, you will receive the booking price paid to us immediately. You also have the option to either book an equivalent adventure from the OÖA offering or choose an equivalent adventure. Further claims against OÖA, especially claims for damages (e.g., travel costs, accommodation), are excluded.
Changes to the Offer
1. OÖA reserves the right to make changes to the person of the organizer or the adventure. In the event of a significant change in the content of an adventure, the customer is entitled to withdraw from the contract free of charge or choose an equivalent adventure from OÖA's offering.
Liability of Oberösterreich Adventures
1. Information about mediated adventures/experiences is based solely on the information provided by the organizers and is not a guarantee from OÖA to the customer.
2. OÖA is not liable for the provision of the mediated adventures/experiences by the organizer but only for the careful selection of the respective organizer, the proper mediation of the experience, and the proper and verifiable transmission of information, advertisements, declarations of intent, and payments between customers and organizers.
3. For damages resulting from the violation of contractual obligations, OÖA is liable without limitation up to the amount of the price of the mediated experience. For damages beyond this, OÖA is only liable in cases of intent or gross negligence.
4. OÖA assumes no liability for the unauthorized redemption of vouchers. In case of loss or theft of vouchers or tickets, the customer is therefore obliged to contact OÖA immediately so that the code can be blocked.
Retention of Title / Withdrawal for Non-Payment / Consequences of Default in Payment
1. Until full payment is made, the voucher remains the property of OÖA. Payment must be made no later than one week after invoicing (invoice date). After this payment deadline has expired, OÖA has the right to withdraw from the contract at any time or to cancel the voucher, resulting bookings, or credit. Legal claims regarding the consequences of default in payment remain unaffected. The redemption of the voucher is only possible under the condition that the purchase price for the voucher has been fully paid to OÖA.
Other Provisions
1. The ineffectiveness of individual provisions of the mediation contract or the general terms and conditions does not result in the ineffectiveness of the entire contract.
2. The competent court in Ried im Innkreis is agreed upon as the place of jurisdiction for all legal disputes arising from a contract with business customers.
3. All image and text material may only be used with the consent of OÖA.
